This Disclaimer is issued by HealAssist Healthtech Private Limited ("HealAssist," "Company," "we," "us," or "our") in conjunction with the Terms of Use and Privacy Policy. This Disclaimer provides critical information about the nature, limitations, and risks associated with using the HealAssist Platform and its services.

This Disclaimer supplements the Terms of Use and Privacy Policy. Please read this Disclaimer carefully in its entirety before using the Platform. By using the Platform, you acknowledge, accept, and agree to all disclaimers, limitations, and risk acknowledgments outlined herein.

1. General disclaimers

1.1 Platform nature and purpose

HealAssist is a hospital discovery, comparison, and patient-hospital facilitation platform only. The Platform is designed to help patients discover and compare hospitals and healthcare services available in India. HealAssist is NOT:

• a) A healthcare provider or medical practice;
• b) A medical referral service or medical recommendation service;
• c) A telemedicine platform or telehealth service;
• d) A medical diagnosis or treatment platform;
• e) An emergency medical service;
• f) A substitute for professional medical consultation;
• g) Regulated or licensed as a healthcare provider;
• h) Subject to healthcare licensing requirements (except as a non-medical business platform).

1.2 No medical services or medical advice

HealAssist does not and does not intend to:

• a) Provide medical advice, diagnosis, or treatment;
• b) Recommend specific hospitals or treatments — patient-hospital matching is based on non-medical factors;
• c) Make clinical decisions — all clinical decisions are between you and your treating provider;
• d) Perform medical functions or practice medicine in any form;
• e) Substitute professional judgment — Platform information never substitutes for a licensed physician.

1.3 No liability for medical decisions

You acknowledge and agree that any medical decision you make based on information from the Platform is entirely your responsibility. For any medical concerns, you must consult a licensed healthcare professional. Self-diagnosis or self-treatment based on Platform information is expressly prohibited.

2. Emergency medical situations

2.2 Emergency response required

In the event of any medical emergency:

• a) Do not attempt to use HealAssist for emergency assistance;
• b) Dial 112 (Unified Emergency Services) without delay;
• c) Go to the nearest hospital emergency department or trauma center immediately;
• d) Contact emergency ambulance services in your area (dial 108);
• e) Do not delay in seeking immediate professional medical care.

2.3 Emergency examples

Medical emergencies include (but are not limited to): severe chest pain or difficulty breathing; loss of consciousness; severe bleeding or trauma; sudden severe headache; signs of stroke; severe burns or chemical exposure; poisoning; severe allergic reactions; choking; or any life-threatening situation.

2.4 No liability for emergencies

HealAssist shall not be liable for any delay in receiving emergency medical care, any adverse outcomes, failure to provide emergency assistance, any injury or death resulting from emergency situations where the Platform was used or relied upon, or failure to receive timely emergency treatment due to Platform use.

2.5 Acknowledgment of emergency risk

You acknowledge that using the Platform during emergencies is extremely dangerous, that delay in seeking emergency care can result in serious injury or death, and that HealAssist cannot and will not provide emergency assistance.

3. Hospital and healthcare provider disclaimers

3.1 Hospital independence

All hospitals, healthcare providers, and medical institutions listed on the Platform are independent entities. HealAssist does not control, own, manage, or operate any hospitals; does not employ or supervise hospital staff; does not perform quality assurance or credentialing; does not verify credentials, qualifications, or professional licenses; and does not inspect hospital facilities.

3.2 Hospital liability

HealAssist is not liable for any act, omission, conduct, or decision of hospitals or healthcare providers. Each hospital is solely responsible for medical services, professional standards, staff competence, patient safety, informed consent, confidentiality, informed medical decisions, and treatment outcomes.

3.3 Hospital conduct and negligence

HealAssist is not liable for medical negligence or malpractice, inappropriate diagnosis or treatment, surgical errors or complications, hospital-acquired infections, medication errors, failure to diagnose, breach of patient privacy, unauthorized procedures, fraud, violations of medical ethics, or regulatory violations.

3.4 Hospital selection is your decision

Selecting a hospital is entirely your personal decision. HealAssist's listing of a hospital does not constitute a recommendation, endorsement, or guarantee. You must independently verify hospital credentials, services, pricing, and qualifications before engaging.

3.5 No quality guarantee

HealAssist makes no warranty regarding hospital safety, accreditation, cleanliness, staff qualifications, compliance, service quality, treatment outcomes, pricing accuracy, or information accuracy.

3.6 Hospital information accuracy

Hospital information displayed on the Platform is the sole responsibility of the hospital, is not independently verified by HealAssist, may be inaccurate or outdated, and is subject to change without notice. You must independently verify all hospital information through direct contact.

3.7 Release from hospital liability

By using HealAssist and engaging with any hospital through the Platform, you release HealAssist from any liability arising from hospital conduct, services, or decisions, and waive claims against HealAssist related to hospital conduct or medical outcomes.

4. Information and data accuracy disclaimers

4.1 General accuracy disclaimer

HealAssist makes no warranty regarding the accuracy, completeness, timeliness, or reliability of any information on the Platform, including hospital information, pricing, facilities, doctor qualifications, availability, medical information, comparison data, user-generated content, or third-party data.

4.2 "As is" disclaimer

The Platform is provided "as is" and "as available" without any warranties, express or implied, including implied warranties of merchantability, fitness for purpose, accuracy, non-infringement, absence of viruses, uninterrupted access, or compatibility.

4.3 User verification obligation

You assume sole responsibility for verifying all information before relying on it, independently confirming hospital information through direct communication, assessing relevance for your specific needs, and conducting independent due diligence.

4.4 Self-declared information

All personal information you provide is self-declared. HealAssist does not verify your name, age, identity, or insurance information; does not perform background checks or identity verification; and is not liable for consequences of inaccurate information you provide.

5. Service availability and technical disclaimers

5.1 No guarantee of availability

HealAssist does not guarantee continuous, uninterrupted, or error-free access. The Platform may experience scheduled maintenance, unscheduled downtime, internet connectivity issues, performance issues, partial outages, complete discontinuation, data loss, or device incompatibility.

5.2 No liability for service interruptions

HealAssist is not liable for any downtime, service interruption, loss of access, or any damage or loss resulting from maintenance, system failures, third-party outages, connectivity issues, device incompatibility, or any cause whatsoever.

5.3 Right to modify services

HealAssist reserves the right to add, modify, or remove features without notice; change the user interface; alter functionality; suspend or discontinue services; change underlying technology; or completely discontinue the Platform without compensation.

5.4 Disclaimer on technical support

HealAssist is not obligated to provide technical support. Any support provided is offered "as is" without warranties; response times and availability are not guaranteed.

6. Intellectual property disclaimers

6.1 Intellectual property ownership

All intellectual property in the Platform, including trademarks, logos, design, code, algorithms, content, databases, and features, is owned by HealAssist. You are granted a limited, non-exclusive, non-transferable license for personal, non-commercial purposes only.

6.2 Copyright and content disclaimers

• a) All content on the Platform is protected by copyright law;
• b) Unauthorized copying, reproduction, or distribution is prohibited;
• c) Reverse engineering or decompilation of the Platform is prohibited;
• d) Automated data scraping or extraction is prohibited.

6.3 Third-party content

Content from third parties (including user-generated reviews, hospital information, or third-party services) is provided "as is" without warranties. HealAssist is not liable for third-party content.

7. User conduct and prohibited activities

7.1 Prohibited activities

You are strictly prohibited from scraping or extracting data, reverse engineering, transmitting malware, spam or harassment, fraudulent activities, illegal activities, unauthorized system access, or any conduct that violates these Terms or applicable law.

7.2 Liability for prohibited activities

By engaging in prohibited activities, you accept full liability for any legal consequences, damages, or losses resulting from such conduct.

8. Payment and financial disclaimers

8.1 No financial services

HealAssist is not a financial services provider. The Platform does not process payments for hospital services, handle financial transactions, guarantee payment processing, manage medical financing or insurance claims, or provide financial advice.

8.2 Direct payment model

All payments for hospital services are made directly between users and hospitals, not through HealAssist. HealAssist is not a party to payment transactions and is not liable for payment disputes.

8.3 No refund guarantee

No refunds are provided for hospital services rendered, medical treatments commenced or completed, any healthcare services, or for any reason whatsoever after treatment has commenced. Hospital refund policies are governed by agreements between users and hospitals.

8.4 Financial disclaimers

HealAssist assumes no liability for payment fraud, payment processing failures, payment disputes, financial loss, chargebacks, or identity theft.

9. Privacy and data security disclaimers

9.1 Data handling

While HealAssist implements reasonable security measures, no electronic transmission is 100% secure, data breaches are possible, data is shared with hospitals and service providers, and hospitals are responsible for their own data security.

9.2 Privacy policy limitations

The Privacy Policy describes data practices but does not guarantee privacy or data security, prevent access by authorized parties, prevent hospital data sharing, or prevent legal or regulatory disclosures.

9.3 Data breach disclaimer

In the event of a data breach, HealAssist is not liable for unauthorized data access; you assume the risk; HealAssist's liability is limited per Terms of Use; and notification will be provided where legally required.

10. Third-party links and external services

10.1 External links disclaimer

The Platform may contain links to third-party websites. HealAssist is not responsible for third-party content, services, or practices; does not endorse or recommend third-party websites; does not verify accuracy or legality; and is not liable for any damage from third-party services.

10.2 Third-party terms and policies

By accessing third-party websites through HealAssist links, you agree to third-party terms, accept third-party privacy policies, and release HealAssist from liability related to third-party sites.

10.3 No responsibility for third-party conduct

HealAssist is not responsible for third-party website functionality, service quality, data security practices, fraud, or any damage from third-party services.

11. User-generated content disclaimers

11.1 User reviews and ratings

Users are solely responsible for content accuracy; reviews and ratings are not verified by HealAssist; reviews may be biased, fraudulent, or inaccurate; HealAssist does not endorse review content; you must independently assess reviews.

11.2 Review accuracy

Reviews may be written by biased individuals, may contain false statements, may not reflect actual experiences, may be outdated, and are not factual or verified data.

11.3 No liability for user content

HealAssist is not liable for user-generated content, including false reviews, fraudulent ratings, offensive content, or content violating intellectual property rights.

12. Limitation of liability

12.1 Comprehensive liability limitations

To the maximum extent permitted by applicable Indian law, HealAssist's liability is limited as set forth in the Terms of Use. HealAssist is not liable for medical harm or injury, missed opportunities, economic loss, consequential damages, punitive damages, data loss, business disruption, or any damages arising from Platform use.

12.2 Medical disclaimers in liability

HealAssist is not liable for medical negligence at hospitals, misdiagnosis, medical complications, hospital-acquired infections, death or serious injury from treatment, emotional distress, long-term disability, or any medical harm whatsoever.

12.3 Waiver and release

By using the Platform and engaging with hospitals, you irrevocably waive and release HealAssist from any claims, damages, or liability related to your Platform use or hospital engagement.

13. No warranty disclaimer

13.1 Comprehensive warranty waiver

Disclaimer of all warranties: Except as expressly stated in the Terms of Use, the Platform is provided "as is" and "as available" without any warranties, including implied warranties of merchantability or fitness, accuracy, non-infringement, reliability, availability, security, legality, hospital quality, medical appropriateness, or any other warranty.

13.2 Entire risk assumption

You assume the entire risk of using the Platform, engaging with hospitals, and making medical decisions based on Platform information.

14. Acknowledgment of disclaimers

14.1 Your agreement

By accessing and using the HealAssist Platform, you acknowledge you have read and understood this Disclaimer, accept all disclaimers and risk acknowledgments, agree you are using the Platform at your own risk, understand the limitations of HealAssist's services, and release HealAssist from all liability.

14.2 No modification

This Disclaimer cannot be modified, waived, or altered by any communication from HealAssist representatives. Only written amendments signed by authorized representatives can modify this Disclaimer.

15. Severability

If any provision of this Disclaimer is found invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall continue in full force and effect.

16. Governing law

This Disclaimer is governed by the laws of India and shall be subject to the exclusive jurisdiction of courts in Gurugram, Haryana, India, as set forth in the Terms of Use.
